Introduction to the protection of cultural, archaeological, and historical resources with emphasis on key federal and state laws. (Once a year)
Notes
This course examines case law and the application of federal and state constitutional, statutory, and administrative provisions relevant to Hawaiian historic and burial sites protection and their place within Hawaiʻi's land use regulatory system. The case study method will be utilized in analyzing legal controversies surrounding Native ancestral burials, culturally protected items and properties. The course will also include exposure to experts in the field of indigenous archaeology and anthropology to provide a contextual framework for legal work in this area. Students will also participate in community education and outreach efforts on Hoʻi Hou i Ka Iwikuamoʻo: A Legal Primer for the Protection of Iwi Kūpuna in Hawaiʻi Nei.
